General Provisions

This contract is a public proposal (offer) from FOP Klymenko M.I. (hereinafter - Seller) for the sale of Goods (hereinafter - Goods) to an unlimited circle of individuals through the Internet resource and developed in accordance with the requirements of the Civil Code of Ukraine, Laws of Ukraine "On Protection of Consumer Rights", "On Advertising", "On Electronic Documents and Electronic Document Circulation", "On Information Protection in Information and Telecommunication Systems", "On Telecommunications", "On Payment Systems and Money Transfers in Ukraine", "On Personal Data Protection", Rules of international payment systems VISA International and MasterCard International, and other regulatory acts of Ukraine.

According to Article 642 of the Civil Code of Ukraine, the moment of full and unquestionable acceptance by the Buyer of the Seller's proposal to conclude a Public Offer Contract (acceptance of the offer) is considered to be the fact of the Seller's use of the website zarmilkas.com in any way, in particular, but not limited to – registration of an order by the Buyer on the Seller's Internet site.

By concluding this Contract, the Buyer confirms that they are fully and completely familiar with and agree with its terms, and in case the Buyer is a natural person, grants permission to process their personal data for the purpose of fulfilling the terms of this Contract. Permission to process personal data is valid indefinitely.

This public offer is binding for performance by the parties. In case of your disagreement with the terms of this public offer, you should refrain from using the website zarmilkas.com

Definitions and Terms:

1. Website – a web site with an address on the Internet zarmilkas.com through which the Buyer has the opportunity to purchase desired goods.

2. User - a natural person who has reached 18 years of age, who has full legal capacity, or a legal entity that uses this site, who has agreed to the terms of the Public Offer and fulfilled all its conditions described below.

3. Buyer - a User who made a purchase on the website zarmilkas.com

4. Website Administrator – a company/person managing the website zarmilkas.com, FOP Klymenko M.I. (location address: Khmelnytsky city, Stepan Bandera lane, 1/1)

5. Contract - this public offer, including all its terms.

6. Seller - a legal entity or natural person-entrepreneur who places information about goods on the Site. The name of the Seller is indicated in the documents for the transfer of goods to the Buyer (act of acceptance-transfer, expense invoice, goods receipt, fiscal receipt, etc., confirming the fact of transfer of goods to the Buyer).

7. Goods – goods, information about which is placed on the Site.

8. Order - an appeal by a person through the Site and/or by telephone to the Seller with a request to sell goods, as well as a set of goods specified in the User's order.

9. Payer - a person who pays for the User's order.

10. Recipient - a person specified by the Payer in the Order form as the person authorized by the Payer to receive the goods. Unless otherwise specified in the Order form, the Recipient is the Payer.

11. Offer - information about goods placed by the Seller on the Site, which includes information about the goods, its price, methods of payment and delivery, information about discounts and promotional offers on the goods, as well as other conditions for purchasing goods. The terms of Offers placed on the Site are established by the Seller. An Offer is information about possible conditions for purchasing goods.

12. Parties - Seller, Buyer, User.

1. Subject and Terms of the Contract

1.1. This Agreement regulates the procedure for a User's access to information placed on the Site, the procedure for using the Site, as well as the possibility of transferring goods to the User.

1.2. This Agreement is a public offer. By using the materials and tools of the Site, the User unconditionally and unquestionably accepts (acceps) the terms of the Contract. The User is obliged to fully familiarize themselves with the terms of the Contract before placing an Order on the Site. User registration on the Site or placement of an Order means complete and unconditional acceptance of the Contract (in accordance with Articles 641, 642 of the Civil Code of Ukraine).

1.3. Information about goods is displayed on the website zarmilkas.com and is dynamic. This means that information may be updated, changed and supplemented by the Site Administrator at any time without prior notice to the User. Any information about the Seller's goods, promotional terms, goods prices, and any other rules for providing services by the Seller are displayed on the website zarmilkas.com. The Site Administrator has the right to unilaterally change the terms of the Contract at any time. Changes take effect from the moment a new version of the Contract is posted on the website zarmilkas.com.

1.4. This Contract may be concluded by a legally capable and able User, taking into account the peculiarities provided for in Chapters 4 and 7 of the Civil Code of Ukraine. By accepting the terms of the Contract, You confirm your legal capacity and ability, assume obligations that arise from the use of the website zarmilkas.com and the conclusion of the Contract.

1.5. The User, after familiarizing themselves with the offer posted on the site, has the right to make an offer to the Seller by filling out the Order form and/or by placing an order by telephone at the number specified on the Site. Filling out the Order form is considered an offer from the User to the Seller to purchase goods on the terms specified in the corresponding Offer.

1.6. An offer is considered accepted by the Seller if the Seller takes actions that indicate acceptance of the User's offer, namely: actually shipped the goods in accordance with the conditions provided for in the User's offer, provided an invoice for payment of the ordered goods.

1.7. The Seller has the right to offer to sell goods on other terms after receiving the User's offer. In such
